Businessman and wife admit to threesome with Dutch model who fell to death from KL apartment

An American businessman and his Kazakh wife have admitted to a threesome with 19-year-old Dutch model Ivana Esther Robert Smit, who was found dead on Dec 7, 2017.

Smit had fallen to her death from the balcony of an apartment in Jalan Dang Wangi, Kuala Lumpur in Malaysia. 

Alex Johnson, 44, and his 31-year-old wife, Luna, said they engaged in sexual acts with Smit three weeks earlier and also on the day when she was discovered dead.

The couple confessed that all three of them had been drinking heavily and Smit had been taking drugs. 

The two first got to know Smit via a mutual acquaintance at a Kuala Lumpur nightclub in October 2017, reports The Straits Times

Luna said:

“She asked me to stand up and dance with her. We weren't kissing, but we were doing sexy moves.

“She was beautiful, charming, confident. I was already melting.”

The couple and Smit even had a WhatsApp group which contained explicit flirting. 

They then had a threesome in a five-star hotel in November 2017. 

On Dec 7, 2017, the day when Smit was discovered dead, all three of them had been out partying all night before retiring home early morning. 

The Johnson’s daughter woke up and the couple reportedly went to have breakfast with her. 

Luna added:

“Ivana was hammered. I kept talking to her as I got my daughter ready for school. Ivana lay down while I took her there.”

Luna said that she was out for about 30 minutes. 

When she returned, her husband and Smit were on their bed but Johnson was asleep.

Luna and Smit then got intimate, before Luna went back to her bedroom and lay down with Johnson. 

She came out of the room at around 10am, and found Smit wandering as she giggled and talked to herself. 

Said Luna:

“I was so tired after all this partying. At 10.15am, I went back to the bedroom. When my head hit the pillow, I passed out.”

She then woke up at around 1.25pm and saw Smit’s clothes, shoes, bag, and phones scattered in the lounge and kitchen.

The couple thought that she had gone for a photo shoot.

They were awoken by the police at 5pm. 

Luna and Johnson have maintained their innocence in the matter and said that footprints found on the balcony and on top of the air-conditioning units, prove that Smit had fallen on her own, and there was no evidence of foul play. 

However, their claims are contested by family members of Smit.

Smit's father, Marcel, even speculated that his daughter had been pushed from the balcony. 

Johnson also revealed that after the incident, he received several death threats and someone even attempted to kidnap his five-year-old daughter.

Said Johnson:

“A man phoned our nanny, Maha, saying he was Luna's father and would be picking her up from school. Luna's father died before she was born.

“We never intended to make the details of our marriage public. Now we fear our own lives are in danger, and we have no choice.”

Smit’s family lawyer had told Dutch newspaper De Telegraaf that she had sex just hours before she was discovered dead, citing the discovery of male DNA in her body. 

The lawyer Sebas Diekstra added that pathologist Frank van de Goot, who carried out the second autopsy, had previously detailed finding male DNA in Smit's body and held the opinion that sex likely occurred in the last hours of her life.

Dijkstra said:

“In the Netherlands, you can be prosecuted if you commit sexual acts on someone who is unconscious or under reduced consciousness.”

The Smit family spokesman, Fred Agenio said his niece was not in control of herself nor her actions in the hours leading to her death.

He said:

“There were huge amounts of drugs found in Ivana's body. She was no longer competent.

“If anyone still had sex with a 19-year-old girl who was in that condition, that's not good. They should stay away from someone under such circumstances.”
